Military Reservist Called to Active Duty - How does this affect administration of COBRA benefits?
Recently, many military reservists have been called to active duty and it is expected that more will be called throughout the next year. A leave of absence to perform military service is a COBRA qualifying event. The Uniformed Services Employment and Re-Employment Rights Act of 1994 (USERRA), prohibits all employers from discriminating against employees who take a leave of absence from their jobs for military service and guarantees the right to reemployment, with full benefits, when they return.
